Private Tutoring Agreement
This Private Tutoring Agreement ("Agreement") is made and entered into as of the date of booking by and between:
Tutor: Ashley Brookshire; AB Tutoring (hereinafter referred to as "Tutor") AND Client: (hereinafter referred to as "Client") - Client details will be collected during the booking process.
1. Services Provided: The Tutor agrees to provide private tutoring services. Sessions will be held at the Tutor’s home or online via video conference at mutually agreed-upon times.
2. Fees and Payment: The agreed-upon fee for tutoring services is listed on the booking website. Payment is due either at the time of booking or by end of day on the day of the session. Accepted payment methods are: Zelle, cash, check, or credit card.
3. Cancellation Policy: Client understands and agrees that a minimum of twenty-four (24) hours' notice is required for any cancellation or rescheduling of a tutoring session. Notice must be provided directly to the Tutor via: phone call, text message, or email. If the Client fails to provide at least twenty-four (24) hours' notice of cancellation, the Client will be charged for the full cost of the scheduled session. This charge is to compensate the Tutor for their time and loss of potential income due to the late cancellation.
4. Tutor's Responsibilities: The Tutor agrees to:
Be punctual and prepared for each session.
Provide effective and individualized instruction.
Maintain a professional and respectful demeanor.
Communicate any concerns regarding the student's progress to the Client.
5. Client's Responsibilities: The Client agrees to:
Ensure the student is prepared for each session (e.g., has necessary materials, has completed assigned homework).
Make timely payments for services rendered (see fees and payments).
Communicate any concerns or feedback to the Tutor.
6. Term and Termination: This Agreement shall commence on the date of the first booking and continue on a session-by-session basis until terminated by either party. Either party may terminate this Agreement at any time with 24 hours’ notice.
7. Video and Audio Recording for Safety and Security: To ensure the safety and security of both the tutor and all students, and to maintain a professional and secure learning environment, all tutoring sessions conducted on AB Tutoring's premises and within our designated tutoring spaces, or during online sessions, as applicable, may be recorded via video and audio surveillance. This recording is for safety and security purposes only, and the footage will be stored securely and accessed only as necessary for legitimate safety, security, or legal reasons. By signing this Agreement (electronically or physically), the Client acknowledges and expressly consents to the video and audio recording of tutoring sessions as described herein. The Client understands that failure to consent to such recording may result in the inability to provide tutoring services.
8. Confidentiality: All information shared between the Tutor and Client regarding the student's academic progress and personal information will be kept confidential.
9. Release of Liability: I, the undersigned Client, hereby release the Tutor from any and all liability, claims, and demands either in law or in equity, which arise or may hereafter arise from the tutoring services provided. I understand and acknowledge that this Release discharges the Tutor from any liability or claim that I may have against the Tutor with respect to any bodily injury, personal injury, illness, or death that may result from the tutoring services provided.
10. Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter hereof.
